View on GoogleInsurance Coverage & Rideshare Accidents
In recent years, ride share services like Uber and Lyft have gained tremendous popularity in New York City and the surrounding areas. Not surprisingly, more cars on the road providing ride share services have resulted in an increase in accidents. One of the most frequent questions that our New York City Uber accident lawyers are asked is "Who pays the medical bills after an Uber accident"?
When an Uber or Lyft accident occurs in New York, the driver's rideshare app is an important factor that can determine whose insurance coverage applies. Let's take a closer look:
The Driver Is Not Using the App
When an Uber driver is unavailable to provide rides and is not using the Uber app, the driver's own insurance policy will cover an injured passenger's medical bills and lost wages, regardless of fault, up to a certain limit.
Lyft drivers are also covered by their personal insurance when the Lyft app is off. The minimum amount of personal injury protection (PIP), also known as no fault coverage insurance, you must carry in New York is $50,000. When the driver is at fault for an accident, they can be sued for personal injury damages.
The Driver Is Available, But Not Carrying Passengers
When the app is activated and the driver is available to give rides, Uber Technologies, Inc. provides third-party liability coverage for lost wages and medical bills of at least $50,000. Lyft maintains similar coverage when the driver is available.
Both the driver and the ride sharing service (such as Uber Technologies Inc. or Lyft) can be sued for personal injury damages resulting from a rideshare accident.
The Driver Has Accepted a Ride Request
When the driver accepts a ride request, Uber Technologies, Inc. has a $1 million third-party liability policy that kicks in. This applies from the moment the ride request is accepted until the trip has ended.
Lyft also provides $1 million for third-party auto liability insurance after a ride has been accepted.
Who Will Pay?
So whose insurance company is going to pay for the losses you have suffered as an Uber passenger, Uber driver, or someone else who has been injured in an accident involving an Uber? This will largely depend on who is responsible for the rideshare accident. Once that has been determined, do not expect an easy payout from your own insurance, the responsible party's personal insurance, or Uber's insurance company.
The surest way to collect the compensation you deserve from your injury claim is to hire an attorney who can prove who is liable and whose insurance policy should be used to pay your damages.
You Have Three Years to File a Case Get In Touch With an Injury Lawyer

I was in an accident while riding in an Uber. Should I just take this up directly with Uber?
No. Although you should report the accident to Uber through the app, you should not talk about the accident with anyone who reaches out to you on behalf of Uber or any other party. Remember: insurance is a business, and it benefits them to pay you as little as possible. Hire an attorney and let them speak to the adjustor so that no one minimizes your claim.
Who are all the parties I need to notify of an Uber accident?
As with any accident, once you have called 911 on behalf of any injured persons, your first call should be to the police. Next, call an Uber accident attorney. An injury attorney with Michael H. Joseph, PLLC serving Greater New York City can take care of speaking to all insurance representatives on your behalf to ensure you secure the best possible payout.
I am an Uber driver who was in an accident that was somebody else's fault. Does Uber's insurance policy cover anything for me?
Once you have activated the Uber or Lyft app, under New York law, all Uber and Lyft drivers are employees, so you are entitled to workers compensation benefits. If you are injured because another party was at fault, you can sue that other party and their insurance company is responsible for compensating you for your injuries. In cases the other driver responsible for the accident is uninsured or under insured, Uber maintains uninsured motorist coverage and under insured motorist coverage for you and your passengers."Top-notch service!"
