We Strive to Represent All of New York City and the Suburbs
/
NYC is an incredibly diverse city. We believe everyone in the Big Apple deserves access to proven legal representation. Our team speaks both Spanish and Portuguese. We also have offices in both Midtown Manhattan, where we represent people injured in E-Bike and Electric Scooter accidents in Manhattan, the Bronx, Queens and Brooklyn, as well as White Plains, where we represent people injured in E-Bike and Electric Scooter accidents in Westchester County and Rockland County.
Our State's E-Scooter and E-Bike Laws
In 2020, new laws went into effect that allowed people throughout our state to operate e-bikes and e-scooters in certain, limited circumstances. Electric scooters and bicycles with electric assist can be operated without registration.
These vehicles can be driven on 30 MPH speed limit or less highways. They cannot be driven on a sidewalk unless specifically authorized by local authorities. Municipalities can also implement further restrictions on the use of electric scooters and e-bikes.
Victims Are Often Wrongly Blamed For Electric Bike and E-Scooter Accidents
New York's laws concerning scooter and e bike accidents can be confusing. Negligent drivers and their insurance companies often misrepresent who is at fault under the law to blame victims for their electric scooter accidents. They may have even accused you of breaking the law and thereby causing your crash.
Our NYC personal injury attorneys pride ourselves on standing up to these intimidation tactics. Michael H. Joseph has been practicing law since 2000. Over his nearly 25-year career, our lead personal injury lawyer has built strong relationships with accident reconstruction specialists and other experts who can help us prove that your behavior was lawful and that you are entitled to compensation.

View on GoogleYou Can Still Receive Compensation Even If You Were Partially At Fault
Some states operate under contributory negligence laws that bar any financial recovery if a victim were even partially at fault for their scooter accident. New York does not use these restrictive regulations.
Instead, our state uses the legal framework known as comparative negligence. These laws allow plaintiffs to receive compensation even if they contributed in part to their injury. The compensation received is proportional to how at fault a victim is found. This makes it crucial to retain established trial attorneys like ours who know how to demonstrate that the opposing party was responsible for most if not all of your electric scooter accident.
Your Scooter Accident
May Have Been Caused by Defective Products
Some victims do not pursue a lawsuit because they cannot identify a driver who caused their harm. This leads scooter riders to endure serious harms like concussions, abrasions, and traumatic brain injuries on their own.
You should know that a scooter company can be held liable for electric scooter accidents if they were negligent in the design, manufacturing, or marketing of its device. This type of lawsuit is known as a defective product lawsuit and can be handled by our scooter accident lawyers.
An example of this in action would be a lawsuit against a scooter company that sold an e-scooter with faulty brakes that did not allow a scooter rider to stop in time, leading to a crash.
Waiting to File Can Hurt You
These Cases Have Hard Deadlines
Statute of limitations laws set strict time limits for when different types of lawsuits must be filed by. These deadlines vary state to state.
New York provides three years from the date of harm for a victim to file a personal injury lawsuit. This is longer than the two years or less provided by most states. That being said, these years can pass quickly for a victim focused on physical and financial recovery. If you were recently harmed in a scooter accident, it is wise to start your case now.
If your loved one passed away in a tragic e-bike or scooter accident, we can file a wrongful death lawsuit. Unfortunately, our state only provides two years from the date of a victim's passing for this type of lawsuit to be filed.
