Our White Plains car accident lawyers have decades of experience in representing victims of car accidents in both Rockland and Westchester Counties, as well as New York City.
In this recent case, it appears that the driver lost control of the vehicle and our White Plains car accident lawyers that handle car accident cases in the Rockland Supreme Court, know that the failure to maintain safe control of a vehicle is tantamount to negligence. It appears that the driver will likely be charged and while the charges have not been officially released yet, our Westchester car accident lawyers, know that proving fault in a car accident case becomes much easier when there is a conviction, including a plea of guilty to a Vehicle and Traffic law. Once a driver pleads guilty in a criminal or traffic court to a vehicle and traffic law violation, they are foreclosed in a personal injury case from claiming they were not at fault for the accident. This principal is called res judicata and our Westchester car accident lawyers have used this principle to win summary judgment in car accident cases on may occassions.
New York is a no-fault car insurance state. That means, after a car accident, you typically need to file a claim under your own personal injury protection coverage, or if you are a passenger, under the insurance for the car that you were in, to get compensation for medical bills and other financial losses, regardless of who caused the crash. New York law also allows you to the driver who was negligent and cauesd the crash, if you sustained serious injuries. If you were injured in a car accident in Rockland, call our Westchester car accident lawyers. Our Westchester office is a short drive over the Tappan Zee bridge, also known as the Cuomo bridge. Our consultations are always free and there is no fee unless we win your case.
The New York Car Accident Statute of Limitations
A "statute of limitations" is a law that sets a time limit on your right to bring a lawsuit. If you miss the time limit set by this law and you try to file your car accident lawsuit after the deadline has already passed, the New York court system is almost certain to dismiss your case, unless some rare exception applies to extend the deadline.
In most situations, you have three years, starting from the date of the crash, to get your car accident case started in the New York court system.
Our New York State trial lawyers firmly believe that an action need to be taken at the right time for best results of the case.
